In no event shall PHD be liable for any special, indirect, or consequential damages or any damages whatsoever resulting from loss of use, data, or profits, whether in an action of contract, negligence or other tortuous action, arising out of or in connection with the use or performance of the information or services provided in www.purehdg.com website.
 
PHD may at any time and from time to time revise these Terms of Use by updating this posting. By using this site, you agree to be bound by these Terms of Use and any such revisions thereto and you agree that you should therefore periodically visit this posting to determine the then current Terms of Use by which you are bound.


Indemnity

You agree to indemnify and hold us and (as applicable) our parent, subsidiaries, affiliates, officers, directors, agents, and employees, harmless from and against any claims, demands, proceedings, losses and damages (actual, special and consequential) of every kind and nature, known and unknown, including reasonable solicitors' fees, made by any third party due to or arising out of your breach of this Agreement or the terms and policies it incorporates by reference, or your violation of any law or the rights of a third party.


Disclaimer

As the ordinary or otherwise use of products is outside the control of PHD, no representation or warranty, expressed or implied, is made as to the effect of such use/s, (including damage or injury), or the results obtained. PHD expressly disclaims responsibility as to the ordinary or otherwise use. Furthermore, nothing contained herein should be considered as a recommendation by PHD as to the fitness for any use. The liability of PHD is limited to the value of the goods and does not include any consequential losses.
 
The products on our website are represented in as true a manner, as photographic processes and printing will allow. If you have any questions with regard to how products are packaged or labeled, please contact our office.

Ordering Guidelines

Orders can be placed through our website, by email, fax, or post. Only those orders placed in writing will be fulfilled. We guarantee the accuracy of written orders, however, we accept no responsibility for errors as a result of verbal miscommunication.
 
This site uses the highest industry-standard Secure Sockets Layer (SSL) encryption to transmit credit card information. Only the shopping cart needs to be secure. Orders are processed immediately, therefore cannot be changed, added to, or canceled. Orders are filled one by one in the order in which they were received. Once the order has been processed, any changes will be treated as a new order.
 
All International orders need to be confirmed before the order is processed. Payment needs to be cleared prior to the order being dispatched. The order will be held until the customer advises the final confirmation. For postage and handling costs for international orders please refer to our Postage & Handling Policy. We cannot guarantee delivery times in situations affected by circumstances beyond our control.
 
Whilst we do not impose minimum order quantities, ordering items in bulk can result in substantial savings with regard to shipping costs.
 
If any item is short delivered and has been charged for, PHD will be more than happy to cover the cost of postage and handling in resending the goods as soon as possible. Please note backorders will be shipped immediately they are available.


Returns & Replacements

You can order products without feeling concern or apprehension. Our reputation and your complete satisfaction are extremely important to us. Therefore, if for any reason you aren't completely satisfied, simply contact us immediately.
 
Any discrepancies must be reported within 7 days of receiving your order. You must contact our office first. No returns or exchange will be allowed after 7 days from receipt of your order. If a return or refund is necessary, this must fall within 4 weeks of the invoice date. Returns will not be accepted beyond this period.
 
It may be necessary for clients to return goods by Australia Post, in which case, reimbursement of return freight costs will be included in refund/credit (only if the error is on PHD behalf). International returns can also be accepted for being faulty, damaged, or exchanged. Please ensure full tracking details (airway bill or tracking number) are provided in order to monitor the speed of the parcel being sent back.
 
Goods must be re-packed carefully for return and the package must include a letter identifying your invoice number, name, contact information as well as why the goods are being returned. Whether you require a credit or a replacement, it is extremely important to provide as much detail as possible about what you are returning so that the return can be processed accurately & promptly.
 
If an error has been made by PHD with regards to a written order, either invoicing or packing, we will gladly pay for return shipment. If customer requires urgent re-despatch, it will be necessary to pay for goods at the time the re-order is lodged, which will then be credited/refunded when we receive the returned goods.
 
Errors made by clients when placing their order will not be exchanged or refunded.


Postage & Handling

Australian Locations - Postage and Shipping Charges
Postage and Shipping is charged at a flat rate of $12.00 to anywhere in Australia.
 


Australian Deliveries

Deliveries to Australian destinations are currently shipped via courier service or Australia Post Receipted Delivery and our contractors may be changed at our discretion.
Terms and conditions by Australia Post vary from time to time and are beyond our control.
 
Receipted Delivery means that you must sign a receipt before the parcel/s will be left.
There are many places to which Australia Post has conditional delivery, i.e. there may be weight limits due to subcontractors, high-rise building limits, remote location requirements, etc.
 
If you are not available to sign on delivery, or other Australia Post conditional delivery restrictions apply, your order will be delivered to an Australia Post outlet for your collection. You will be advised by a card in your mailbox when and where parcels are available for collection.
 
You may change our delivery instructions on request; e.g. leave parcel at the back door; however we will not take responsibility if you do not receive it for any reason nor can we track the postal progress of the parcel.
If orders are placed and prepaid before midday (QLD) we will usually dispatch them the same day.
 
Estimated delivery times: Australia Post delivery times are usually from two to four days for populated areas of QLD, NSW, VIC and SA, five days for TAS and seven for Perth and Darwin suburbs. Remote and isolated areas of Australia can, of course, be expected to take longer.
 
If you do not receive your Receipted Delivery parcel/s, or one or more are missing within these estimated times please wait an extra day or two before contacting us.


Overseas Orders – Shipping Services and Charges

If you are ordering from places other than Australia we will contact you via email to arrange a shipping service and payment. Costs will vary from place to place and shipping service selected.
 
You will be billed in Australian Dollars including any currency exchange charges.
Due to ongoing identity and credit card theft there are some countries from which we cannot accept payment with credit card. In these circumstances it will be necessary to transfer the full payment into our Australian bank account prior to order processing.
